The Damage Done By Addiction

It is a personal issue for me but people do sometimes recover. Just this morning I was reading an article by a woman who admitted the difficulty of recovering from the trauma of her past and four addictions. Today’s story –

I am a foster parent and have a one year old child in my home who I have had since she left the hospital. I have a good relationship with her parents, I think about as good as can be expected in this situation. We text frequently, exchange pictures, arrange visits outside of the court-mandated ones. They love her endlessly but are deep into struggles with addiction. Both have had a few stints where they go to treatment for a day or two (so, there does not appear to be a barrier with access to treatment) but do not stick with it. Addiction has been a long-time struggle for both parents.

Her case is very much still open and I am still trying to help them into treatment. But, it’s to the point where the department is asking about permanent placement options. The child has a relative (I think mom’s second cousin, not positive on the exact relationship) who lives about three hours away and is not in contact with the rest of the first family. Relative has said she would adopt if needed, but didn’t want to be the first choice. Parents were asked who they would want to adopt and they said me. I had not talked to them about this and didn’t know it was being asked, so I don’t think they felt pressured. If we get to that point, I would try to facilitate a relationship that’s beyond “open” – i.e., I would invite them to her activities and holidays and would support them seeing her with gas cards and paying for activities and the like. I know many open adoptions end up closed, but to the extent that you can believe an internet stranger, please try to believe that I would not do that.

She also has four half siblings and cousins, aunts, uncles, grandparents (none placement options, unfortunately) in the area where I/her parents live. Under these circumstances, what’s the “best” placement option? (Understanding that the actual best option is with her parents). I’m a foster parent who yells at other foster parents about interfering with kin placements, but it seems like parents should get a say here. How does one weigh the benefits of living with a member of your first family vs living outside of your family but having the option to see them regularly? (I know guardianship would be preferable, but the department won’t do that – so, the options are adoption or not adoption for this case).

First of all, straight up, I would NOT want to go to a relative that didn’t want me.

One response seems realistic to me as well – I would adopt if left no other legal choice. If you do allow her parents to see her when they are able, then I think ultimately it’s what best for the girl, if her parents can’t find their way out of addiction and the state is pushing the issue. A similar response from an adoptee was –  If I was the little one in question, and guardianship was not an option, I would want you to adopt me over the distant relative and keep me in contact with my close family. The deciding factor, for me, is that the distant cousin doesn’t want to be the first option, and that is bound to come across to the adoptee, especially if times get tough when they are older. It’s hard enough to know that your biological parents didn’t want to/couldn’t raise you, but when you start getting the same message from multiple sources, it can really compound the trauma.

Someone else writes – Considering the addiction issues, this child needs a home. If there was NO other option but you vs the cousin, I’d prefer you because you live near her family/parents. But, closing this child off from her family at anytime and getting all “she’s MINE” – no, nope, nada. Being a supportive and caring adoptive mom with the child’s mental and psychological health front and center – providing therapy as needed throughout this child life for issues that will pop up – remembering always that you are not this child’s mother….period. I can be on board for you to provide a stable home for this child.

Finally this from a voice of experience – I was adopted at the age of 9. Both of my parents are addicts. My adoptive parents said they would never keep me from my family. True to their word, they didn’t. When my mom was clean and I asked to go back and live with her, they let me. Even paid my mom child support that wasn’t mandated, just to help out. She relapsed and my adoptive dad actually gave me the choice to stay in foster care and finish high school or for him to come and pick me up, since legally he was my parent. I chose to stay in high school in order to stay near my siblings, instead of moving across the country. If you are really going to keep it open, with access to the child’s family, I would say you are the better option than a long distance blood relative who doesn’t speak to the family. I just hope that you always give her parents grace and don’t cut off communication when you are mad. Especially if the child wants to keep that communication open.

The Obstacles Are Daunting

I was reading through a story this morning. No idea of the reasons this young father is incarcerated but he seems to care about his child in foster care. I’ll do my best to sum up the situation and share someone else’s personal experience in a similar situation.

A baby girl was placed with a foster family. The father won’t be released for another 4 years. The mom has never shown up for court dates. The father was forced to since he is in the state’s control. The foster parents were petitioning the state for a ruling of abandonment on behalf of the little girl in their care. In court, this father said that he did want his daughter. He claims he has previously sent a list of family members who might be willing to care for her until he is released. The caseworker is now doing background checks on his family members to determine if any of these are suitable to care for his daughter until he is available. This foster parent is angry because this little girl has been with her since birth. So she claims that placing this little girl with anyone else will be traumatizing because her foster parents are the only parents she has ever known. She actually says, “I pray that none of his family are suitable.”

The response from experience – my dad was in jail when my mom lost her rights and the state REFUSED to keep me in foster care till he got out (less than a yr sentence). My dad was so mad about it he ended up flipping out in court and getting more time added onto his sentence because he threatened the lives of everyone in the court room once he learned they were forcing against his rights. My dad got remarried a few years after he got out and ended up having 6 more kids that he still has custody of. He and his new wife kept a portrait of me hanging in their bedroom my entire childhood but I never knew that because I had a closed adoption. My adoptive parents would speak badly about my dad for being in jail. They said he was violent, unhinged, etc etc. I definitely get some of my zest from him!! He was never the psychopath they made him out to be. Just a desperate young dad in a bad situation. He swears to this day that the state kidnapped his daughter. Fathers “rights” are hardly exist. The state could wait until this dad can get out of jail and acquire the stability to take care of his daughter. If there are other family members willing to help out, then great! The state should have been looking for them from the beginning!

If the state has someone in custody, they shouldn’t be hard to track down to discuss custody arrangements and extended family.

Getting Free Of Suspicion

It may be true that addiction is a complicated situation but I still find this story today very sad. I have no answers. I just hope it turns out positively for this mom.

I do outreach for drug/alcohol rehabilitation in my down time on days off. Distribute Narcan, help people get into treatment, etc. I have been working lately with someone new. The lovely woman is only a couple years older than me and she has a 9 month old baby. She got clean as soon as she found out she was pregnant. Baby was born with no drugs in the system. Department of Children and Families stipulated she needed to go to detox/rehab before they would even allow her visitation with her baby. Its a catch 22. She never started using again, so she has been clean a little under 18 months. The rehab facilities around here require drugs in your system for admission. So basically the Department of Children and Families wants her to stay clean and piss dirty simultaneously to do what they want. She refused to get high just to get into a program (go momma!) And we knew if she relapsed the Department of Children and Families would just use it against her. We managed to find a program for her that took her insurance, and did not require the dirty urine. She did her intake on the phone with them and she successfully completed the program. She’s home now, and all the Department of Children and Families will let her have with her baby is supervised visitation because they really do not believe she is clean. In my experience with the system, the more proof we have that someone is clean, the better things go. But she has been clean so long, I’m wondering should we have her do a hair strand test? Since she graduated the inpatient program, she was able to get into the state sponsored outpatient rehabilitation program.

Some more info – they seized baby at hospital. The baby was temporarily placed in foster care but was returned to the biological father once paternity was established. She already had a child removed and also placed in foster care temporarily. This other father (related to the older child) is very understanding and flexible, so things on that front are going well. The father of the infant in question here is flat out stonewalling. The mother is an awesome human. Very kind and honest. The quiet and respectful type. She has got a serious resolve when it comes to not giving up. 

I agree with this comment – She may need a lawyer, this is crazy, if her and baby was clean at delivery her baby shouldn’t have been removed. I would also suggest she motion the court for unsupervised visitation. The Department of Children and Families are not the boss, they are truly the opposition. She can ask the judge for anything she wants. Lawyers often fall in line with the Department of Children and Families. From experience, I won my case with them by motioning to the judge without their approval. This is awful and so sad, I hope she gets her baby back soon.

Someone asked – Why did they take custody of the baby if neither the woman or her baby tested positive for illicit drugs? Well, this is the complication – she already had a child placed in the child welfare system unfortunately due to the previous addiction. So the Department of Children and Families seized the baby at the hospital. The mother is working on regaining custody in that case too. Different fathers, so these are treated as separate cases. The father for the older child is not stonewalling and is actually being incredibly accommodating.

The biological father got custody of the infant after paternity was established. There may be a bit of conspiracy and tag teaming happening with the biological dad and the Department of Children and Families. His attorney keeps filing motions with reason after reason why she shouldn’t be alone with the baby. Stupid thing is we have both weekly and random urine checks going back a full year. And we paid an independent lab to run the screens. So its has been expensive. We have been turning over the lab results that they give us, all their contact info is there to verify the authenticity. But the biological dad says that is not good enough. Its like what is it that you do want?

If you find all of this confusing, I do too. Life is messy. Still I am rooting for this mother !!

It Really Was That Bad

Today’s story –

I was adopted from foster care when I was 12. I was adopted into the same home as one of my biological sisters. Being adopted was the only way I could stay with my younger sister, so I consented. I knew my first family, as I lived with them to the age of ten. Having to leave them, especially my siblings, destroyed me.

Nearly as bad was the family I ended up with. My adoptive mom berated me constantly, and could be very cruel. I was told that my sister and I weren’t wanted, and that’s why my mother kept her other (three younger) kids but gave us up. That we were lucky that she chose us. The day of the adoption she told me that my life now was between her and Jesus.

I have a good relationship with my biological mom and stepdad, and their kids. I love them, and they love me back with a kind of enthusiasm that I never experienced in my adoptive home. Awhile back, my adoptive mom sent me a message, trying to apologize. It was painful, but it made me know for sure that things were as bad as I thought they were.

From the adoptive mom –

A couple of years ago we sat in the livingroom and I made an attempt at making an amends with you. I thought if I had stopped drinking and stayed sober, then the past was the past.

At the beginning, when you moved into our home, I made a feeble attempt at reaching out to you. You cringed and would not trust me, would not call me mom. You already had a mom and I had not even showed I was a safe person. I couldn’t and didn’t listen to your silent pain.

I know I verbally and emotionally abused you. You went to therapy but it didn’t work and I was glad because I did not want my neglect to be exposed. I knew I was guilty for causing the demons that haunted you.

At the height of your anorexia, you were hospitalized and yet I was jealous of you. I know I was insane. It was my own mental illness more than the alcoholism.

I just wanted to tell you that I am so ashamed of not giving you the childhood you deserved. It was my loss, I never really got to know you. I take none of the credit for your strength.

Sometimes It Works Beautifully

Today was Baby A’s birthday. After our celebration at home we picked up her mom in Branson and took her to dinner. We wanted her to be able to be with her beautiful daughter on her birthday. Baby A wasn’t the only one celebrating today. Her mom was celebrating 1 year of sobriety! (She gave permission to post this story so that she can inspire others that they too can overcome adversity.)

We were so honored that B invited us to her meeting to get her one year coin. We got to hear her tell the story of her journey, and I was so proud that she was able to hold Baby A while accepting her coin and announcing to those attending that Baby A would be moving home next Saturday.

Our girls enjoyed getting to know B, and I think there will definitely be a continued friendship between all of us. Through our foster care journey we have had parents look at us as the enemy instead of part of the team. Foster care shouldn’t have to be foster parents vs biological parents. We chose this path for the children to have a safe place to land until the parents are in a better place, or to offer a permanent home for those that need it. We want the parents to succeed. We want to be their support, to be there when they need us, and to celebrate their successes.

Fortunately B accepted us and realized that as much as we love Baby A, and as much as we will miss her, we are on B’s side. She is a wonderful mom, and it’s obvious that Baby A is her princess. I cried tears of joy and pride for B tonight. There will be plenty of tears shed in the future as we adjust to life with one less child in our home, but Baby A will be where she needs to be – with her mommy who loves her so much. We want to always be that support system for them, and hope to always have them in our lives. We love you, B, and will always be here for both of you.

Mirabai Starr in Wild Mercy

I am in the midst of reading Mirabai Starr‘s book – Wild Mercy – and today learned she adopted her children. Hers is a multiracial family. She had made the decision in her youth due to a concern about overpopulation (a concern I shared at one point in my own life). The looming shadow of the climate crisis was another motivation.

Between them, Mirabai and her husband, Jeff, have four grown daughters and six grandchildren. Mirabai’s youngest daughter, Jenny, was killed in a car accident in 2001 at the age of fourteen. On that same day, Mirabai’s first book, a translation of Dark Night of the Soul, was released.

Mirabai writes – I am a mother who has lost her child, Jenny Starr. In the midst of terrible beautiful unbridled mothering I am suddenly childless. I cannot find my way through a world that does not have my girl at its center. I do not understand. I don’t get why you did not make it through the hurricane season of adolescence, why the vessel of our love, of our ferociously devoted love, did not carry you safely back to me.

Her book Caravan of No Despair is the story of her journey through the grief of this tragedy. She has written in an essay Why Mother’s Day Is Still Special To Me that she found her daughter on her thirtieth birthday. “It was early May and we drove to Albuquerque from our home in the mountains of northern New Mexico to meet Jenny at her foster home in the South Valley. I had been prepped for the encounter, and had cultivated a degree of reserve so that I would neither overwhelm the child nor give her false hope in case it was not a good fit and we wouldn’t be following through.”

She continues, “Most children in the adoption system have been abused, neglected, abandoned, and have serious trust issues. I envisioned Jenny as a wild bird landing for a moment in my hand. I must not scare her off. We pulled up to the dilapidated adobe and parked at the curb—my soon-to-be ex-husband, my older daughter, Daniela, whom we had adopted two years earlier on her eleventh birthday, and me. I stepped out of the car and there she was, a toddler on a tricycle, peddling toward us with a shy smile. Look, Mommy, her face said to me, I can ride my bike.

A week later, on Mother’s Day, we brought her home. Jenny’s social worker met us halfway, at the Dunkin’ Donuts in Santa Fe. Jenny clutched the paper bag containing all of her possessions—a couple of pairs of pants that were too small and a flowered blouse that was too big (the new jacket conspicuously missing). She had a “memory book” put together by the staff at her foster home. It contained a picture of a little black baby cut from an ad in a magazine because Jenny did not have any real baby pictures and the Gerber child looked a little, but not very much, like her (and not a thing like me).

Jenny herself dubbed Mother’s Day as our “anniversary.” Every year on that day we celebrated with cake, mostly on our own, as the man who was supposed to be her father never was, and her sister became a teenage mother early on and left home.

The year I turned forty, Jenny turned fourteen. One night in a fit of teenage rebellion, Jenny took my car for a joy ride and never returned. She crashed on the downward slope of a steep mountain pass and died alone under a full moon. It never crossed my consciousness that I would outlive my child or that Mother’s Day would become an unbearable reminder that the daughter into whom I poured the full cup of my love would leave this world, and that I would shatter.

On a personal note – my then teenage daughter once went for a joyride in the middle of the night with a sleep-over friend and they wrecked her step-mother’s car. She called me wanting a plane ticket to Missouri. I knew that her dad and step-mother would look here first and that she needed to face the responsibility for what she had done. It took my parents intervention (who were still in the same city) to keep her from running away (which was my primary concern). I am so grateful upon reading this that she at least survived. It could have turned out tragically.

Assimilation Is The Intention

For many indigenous women, political action regarding children was not about campaigns for
subsidized day cares or cultural arguments about gender, work, and parenting. Child welfare was a literal fight to keep Native children in their homes and in their nations.

During the 1970s, Native American women activists understood the crisis of child adoption
(which had grown rampant in the postwar era) as more than a personal issue affecting individual
families. The removal of Native children from their homes and communities compromised not only parental rights but also tribal sovereignty. Technically, indigenous nations had a legal advantage in the battle for control over Indian child welfare because the right to oversee issues related to children living on reservations existed as an implicit aspect of sovereignty. In practice, however, state courts and welfare agencies largely misunderstood or ignored tribal authority and the interests of indigenous communities and removed Native children from their homes at arresting rates—an average of one quarter of Native American children lived away from their parents during the early 1970s

In response, Native women activists created a child welfare political agenda that not only kept
children in their communities but also addressed the problems that sometimes led to foster and adoptive placements. Although they acknowledged that there were legitimate issues, such as alcoholism, that required some parents to surrender their children, activists did not interpret the current crisis as the result of inadequate parenting. Nor did they place blame exclusively on culturally insensitive child welfare systems. Rather, activists condemned poverty and the vestiges of colonialism for the problems that precipitated child removals. One activist asserted that ‘‘the process of colonization has brought more destruction to these family ties than any internal changes … could have ever created.’’ According to this woman and others, while colonization created the problems indigenous families faced—solutions to them rested with Native nations. Both the programs’ indigenous women activists established and their petitions to the federal government to uphold the right of the tribes to control child welfare focused on increasing tribal agency in addressing the fundamental difficulties that Native families confronted. These activists gained strength from their citizenship in Native nations and framed their work against child removals in the context of tribal sovereignty.

The history of non-Native people intervening in the lives of indigenous families is a long one; arguably as old as the history of colonization itself. The Indian Child Welfare Act (ICWA) of 1978 is Federal law that governs the removal and out-of-home placement of American Indian children. … ICWA established standards for the placement of Indian children in foster and adoptive homes and enabled Tribes and families to be involved in child welfare cases.

“They closed the boarding schools and opened up CPS (Child Protective Services), but it’s the same thing – they’re still coming in and taking our children,” Cetan Sa Winyan said. The Cherokee Nation of Oklahoma, the Oneida Nation of Wisconsin, the Morongo Band of Mission Indians of California and the Quinault Indian Nation of Washington are petitioning the Supreme Court to request that the Indian Child Welfare Act remain intact.

The state of Texas is challenging the constitutionality of ICWA, claiming it’s a race-based system that makes it more difficult for Native kids to be adopted or fostered into non-Native homes. Another argument is that the law commandeers states too much, giving federal law imbalanced influence in state affairs.

A Supreme Court response to the tribes’ petition and the petition filed by the plaintiffs is due on October 8th.

Tribes and advocates argue that ICWA is culturally- and politically-based, not race-based, because tribal nations have political status as sovereign governments under federal law. Cherokee Nation Deputy Attorney General Chrissi Nimmo said the tribe will put all the resources it has into making sure ICWA is protected. “ICWA attempts to keep children connected to their tribe … and an attack on that is absolutely an attack on tribal sovereignty,” Nimmo said.

In the case of Brackeen v. Haaland, the Brackeens — the white, adoptive parents of a Diné child in Texas — seek to overturn ICWA by claiming reverse racism. Joined by co-defendants including the states of Texas, Ohio, Louisiana, and Indiana, they’re being represented pro bono by Gibson Dunn, a high-powered law firm which also counts oil companies Energy Transfer and Enbridge, responsible for the Dakota Access and Line 3 pipelines, among its clients.

2nd Chance Adoption

Dax is a 16-year-old who has experienced the heartbreak faced by far too many youth in the foster care system. Seven years after being adopted, this teen was told it wasn’t going to work out when Dax came out as LGBTQ. He says, the adoptive parents stopped loving him anymore because of who he is.

He thinks that maybe he needs a same-sex couple or at least someone who is understanding about his sexual identification.

He has been featured on a News segment in Oklahoma.

In a Patheos piece, I read –

A family adopts a 9 yr old child, cares for them 7 years and then kicks them out because they are LGBTQ. They ask “Who does that ? What is wrong with people ?

And I get it. My sons live a rather isolated life at the moment due to where we live in sparsely populated rural forested land and because they have received all of their education at home. One of my sons may eventually “come out”. There is more than one person in my husband’s family who has such a sexual identification.

The news segment doesn’t tell us anything about Dax’s former family or whether religion came into their decision.

However, a couple of nights after the segment aired, a woman wrote the station via Facebook.

“We are a LGBTQ+ supportive DHS approved foster/adoptive home. We are open for teen placement. WE HAVE CHICKENS !! (Dax has raised and loves chickens).

The News channel has put her in contact with the child’s case worker, so there may be a happy ending to this story.

Blue Bayou

At the Cannes Film Festival in July, a journalist from the Netherlands thanked the director and star Justin Chon for his movie, which centers on a Korean American adoptee. Chon isn’t actually adopted like his subject, Louisiana bayou-bred Anthony LeBlanc, whom he plays in the movie. The film premieres Sept 17th.

LeBlanc is a tattoo artist with a criminal record. Like many adoptees in the real world, LeBlanc was never naturalized and risks being sent to a country he barely knows, prompting questions around citizenship, belonging, family — and who gets to be considered American. 

Chon said his Korean heritage and the experiences of friends in his immediate community in part compelled him to examine the issues surrounding international adoption. The practice began during wartime “babylifts” after World War II and subsequent conflicts when the U.S. asserted its power in part by “rescuing” orphans from communism to demonstrate its goodwill.

In 1955, the practice was further formalized when an evangelical couple, Henry and Bertha Holt, successfully advocated for the right to adopt Korean “war orphans” through an act of Congress. The couple later launched Holt International Children’s Services, the first large-scale international adoption organization. Foreign born babies those adopted by US parents before 2000 weren’t automatically granted citizenship. 

Chon said that to bring the sort of tenderness and care the subject deserved, he first pored over research and news articles about similar cases. One of the most publicized was the deportation of Adam Crapser, who was adopted from South Korea. He endured abuse and later abandonment by two sets of adoptive parents, none of whom filed for his citizenship. Crapser, who had several arrests on his record, was deported in 2016. 

Variety wrote in a review that “Justin Chon’s Blunt-Force Melodrama Takes on the Injustices of America’s Immigration System.” The system is the system, and its rules and loopholes exist to punish more than they protect. The movie holds little back as it rails against the cruelties and hypocrisies of American immigration law to stirring effect. 

At the film’s outset, it’s clear LeBlanc has turned his life around from rough beginnings. Having spent his childhood passed from one adoptive and foster family to another, and having endured a stint in prison for motorcycle theft, he has finally found emotional stability in the home he shares with Kathy and Jessie, her daughter from a previous relationship, who regards him adoringly as her true dad. 

“Where are you really from?” It’s an invasive question that’s awfully familiar to people of color, one that intrudes its way into our everyday lives.
